Vazquez v. City Of New York et al
Plaintiff had accidentally caused a fire at his sister's house and 3 days after was hanging out at her house when she called the police to complaint about it. Plaintiff was sitting outside the residence when defendant officers approached him, asked if he was Oscar Vasquez, and then punched him, handcuffed him, and dragged him to the police car. Plaintiff was taken to the 115th Precinct and the hospital and charged with Menacing in the Second Degree, Criminal Mischief in the Fourth Degree, Arson in the Fifth Degree, Endangering the Welfare of a Child, Criminal Trespass in the Third Degree, and Harassment in the Second Degree, which were all later dismissed or ACD'd.
