Summary

The plaintiff was confronted by the defendants, Detective DiForte and Detective Leonard at her apartment door on the incident date and time. They ordered her to come to the 68th precinct where they would explain everything. The plaintiff complied. At the precinct, the defendants conducted an interrogation where the plaintiff was read every Miranda warning and order to initial each question and sign the form. Then, the plaintiff was interrogated about the alleged theft at Det. Ayala's (the plaintiff's former employer) home. After the interrogation, the plaintiff was charged criminally with grand larceny because she did not cooperate to the defendant's standards. The plaintiff was never brought before a judge to be arraigned. The DA declined to prosecute and dropped all criminal charges. Sergeant Hain was the supervisor of Detective DiForte and Detective Leonard at the time.
